How do I defend myself in court against a dishonest roommate?
This situation is extremly messy so bear with me. So I let my roomate borrow my truck. We have been friends for 2 years and roomates for less than a month, he only needed it to run down the road and back, being the smart guy I am i checked the milage and when he brings it back almost 5 hours later there is 115 Miles on it. I ask him poliatley to be honest with me and tell me where he went. he freaks out starts getting mad and tells me and my gf to move out. We had just paid him $600 rent the day before for the following month. So we asked for our money back and he went to get it. I had my brother and his friend come over to help me move our stuff and my roomate shows up with his friends and one kid i never saw before comes in and starts yelling and hits my gf in the face instead of me. so we bust them up and his apt gets trashed because his friends came in and started stuff. The police came out took reports and left. The typical expectation from worthless cops in high crime areas. I live in metro phx area in Arizona. Anyways they didnt make us leave because even tho we were not on the lease they could see we lived there and were not going to allow themselves to be used by my roomate as a bouncer. After the fight stopped my roomate and his friend we messed up were in the house alone for 5 to 8 minutes. When the police showed up he stated the laptop had gone missing. This action was from previous words where I threatned to take his tv and his laptop unless he gave us our money we paid him back. He had his friends mother call and pretend to be an attounrney and threaten us with lawsuits if we took his tv. Because taking that was criminal but taking money was not. I knew it was a bluff when I started asking for her crudentials such as her companys name and what number my attourney could reach her at. So after all was said and done my brother leaves and me and my gf stay in our room. He comes in and says hell give us our money back if we give back his laptop. clearly playing games because he had it all along. This guy makes his money by scamming people and has not been employed for several months but makes an easy 15 thousand a month off of scams. So it gives u an idea of how smart he is. So the following day he has an order of protection served on me stating he was in fear for his life due to me and my friends cornering him and threatening him with weapons. That which never occured. So that afternoon he brings his friends over to try and bully my gf out of the apt so they could rummage thru our stuff. She called me and I had my police friends go over to make sure nothing happened. and again they told john and the landlord that even tho we were not on the lease we have all our stuff here and we clearly live there and have established residency. Yet another failed attempt to gain access to my stuff for john. So we move out and get all our things and he sends texts to my gf all the time with constanst accusations because he is probably bored and has nothing better to do. So does anybody have any legal advice on what I can do to get this guy out of my life. I got my things and got a new place and i am trying to move forward but he is constantly making attempts to mess with us and with this order of protection I cannot confront him and tell him to stop. I am going to set up a hearing to get this order of protection quashed today after work but I have no idea what to say when I speak with the judge. I do not want to ruin any chances I have by saying the wrong things. I am nervous because I myself am trying to become a police officer and having a order of protection on my record makes it very hard to become a cop. The only thing I am guilty of in this whole ordeal was making a bad choice in friends. If someone who knows the legal side of things could offer any advice id greatly appreciate it. Thank you
